Its Jobvious, Inc. (“Jobvious”) is committed to protecting your privacy. This Privacy Policy applies to the Jobvious online and mobile platforms (the “Jobvious Platform”) and governs data collection and usage. A “Network Champion” is anyone who uses the Jobvious platform to earn passive income by building a network of Talent. “Talent” is anyone who uses the Jobvious Platform to find employment, thereby earning direct income. By using the Jobvious Platform as a Network Champion and/or as Talent, you consent to the privacy practices described in this statement.
 

Jobvious may modify the provisions of this Privacy Policy from time to time. New provisions will be effective as soon as they are posted here. Please check this page periodically to ensure that you are aware of any change.

 

Data and Information Collection

This Privacy Policy covers data collected through the Jobvious Platform directly from the Network Champion and Talent and data obtained from third parties. If you exit the Jobvious Platform by following a link to a third party website, this Privacy Policy no longer applies. 

Jobvious collects personally identifiable information, which includes your e-mail address, name, address or telephone number and any other personally identifiable information contained in your Jobvious profile and in the resume(s) you upload to the Jobvious Platform. Jobvious may also collect anonymous demographic information, such as your zip code, age, gender, preferences, and interests.

Jobvious may automatically collect information about your computer and/or mobile device, hardware and software. This information can include your IP address, browser type, domain names, access times and referring website addresses. This information is used by Jobvious for the operation of the Jobvious Platform, to maintain quality of the service, and to provide general statistics regarding use of the Jobvious Platform. Jobvious retains data until it is no longer needed by Jobvious to perform its duties to the Network Champion and/or Talent, or until there is a request to delete the data.

If you are a Network Champion who receives payment from Jobvious pursuant to the Network Champion Terms and Conditions, you are required to register with provide certain personal information to Jobvious’ third party vendor HCM software provider (our “Payroll Vendor”). Please refer to the privacy policy of the Payroll Vendor for information regarding the privacy of your data and information provided to their platform. Jobvious is not responsible for the privacy of your data and information entered into or stored on the platform of the Payroll Vendor. Network Champion agrees to unconditionally release and discharge Jobvious, its officers, employees, contractors, directors, successors, board members and assigns from any and all such claims.

If you are Talent on the Jobvious Platform, information from your profile and your resume will be transferred to our third party vendor for purposes of matching you with job postings from the Jobvious Platform (our “Matching Vendor”). Please refer to the privacy policy of the Matching Vendor for information regarding the privacy of your data and information stored in their platform. Jobvious is not responsible for the privacy of your data and information provided to or maintained by the Matching Vendor. If Talent matches with a job posting on the Jobvious Platform and applies for that job, then information from the Talent’s profile, resume and the completed job application will be transferred to the applicable Jobvious client. When that transfer occurs, the transferred data becomes subject to the privacy policy of the Jobvious client to whom it is transferred. Talent should refer to the Jobvious client’s privacy policy for information regarding security and disclosure of their data by the Jobvious client.

By joining Jobvious as a Network Champion and/or Talent, you acknowledge and agree to Jobvious’ use of the Payroll Vendor and the Matching Vendor for the purposes set forth in this Privacy Policy and in the Jobvious General Terms and Conditions and the Jobviou Network Champion Terms and Conditions.
 

Use of Personal Information

Jobvious collects and uses your personal information deliver the services you have requested as a Network Champion and/or Talent. Jobvious collects, records and maintains the activities of Network Champions and Talent undertaken on the Jobvious Platform. 


Jobvious does not sell, rent or lease names of, or information regarding its Network Champions or Talent to third parties. Jobvious may share data with trusted partners to help us perform statistical analysis. All such trusted partner are bound by confidentiality agreements and prohibited from using your personal information except to provide these services to Jobvious, and they are required to maintain the confidentiality of your information.

Jobvious will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Jobvious or the site; (b) protect and defend the rights or property of Jobvious; and, (c) act under exigent circumstances to protect the personal safety of users of Jobvious, or the public.

 

Use of Cookies

The Jobvious Platform uses “cookies” to help you personalize your online experience. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Jobvious services or websites you visit.

 

Security of your Personal Information

Jobvious uses reasonable measures to protect the personal data of Network Champions and Talent from unauthorized access, use or disclosure. Jobvious secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. Jobvious also performs assessments to test the strength of the security of the Platform. However, by creating a profile as a Network Champion and/or Talent, it is understood and acknowledged that information stored on the Jobvious Platforms is not completely secure. Where the security of information is beyond the control of Jobvious, we cannot guarantee its privacy.

 

Asset Sale or Acquisition

Any information collected in accordance with this Privacy Policy may be disclosed to a third party for purposes of evaluation in the event of a change in control or sale of all or substantially all of the assets, a reorganization, transfer, assignment or any other disposition of all or part of Jobvious or Jobvious stock. Similarly, data collected pursuant to this Privacy Policy may be disclosed to a third party in the event Jobvious acquires or merges with a third party.

 

Access and Deletion of Personal Data

A Network Champion and Talent may request access to their data on the Jobvious Platform by contacting Jobvious via the website, www.itsjobvious.com. Data on the Jobvious Platform may also be viewed by logging into your profile and viewing it directly. If a Network Champion or Talent would like to delete their data from the Jobvious Platform, they must delete their profile in the Jobvious Platform. At the same time, the Network Champion or Talent should contact Jobvious via the website and request all data be permanently deleted.

 

Your Rights under the California Consumer Privacy Act

Under the California Consumer Privacy Act (the “CCPA”), a company meeting certain criteria must provide privacy policies which outline California consumers’ privacy-related rights, and the obligations of the company thereto. The CCPA gives certain consumers that reside in California (“California Consumers”) the right to know what categories of personal information Jobvious collects about them and how and for what purposes we use and share that information.

As used in this Privacy Policy, “personal information” under the CCPA means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. personal information includes, but is not limited to, the categories of personal information identified below if such information identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual or household.

The CCPA helps protect the personal and sensitive data of all consumers, including but not limited to, California Consumers. When you contact Jobvious about your personal information, please clearly explain the action you would like Jobvious to take, i.e., provide data access, portability or deletion. In order to perform any of these actions and receive your data Jobvious requires you share sufficient personal information so that we are able to verify your identity. Jobvious will not discriminate against you if you exercise of your rights under the CCPA.

Right to Deletion

You have the right to request that Jobvious delete the personal information we collect from you. However, in certain situations we are not required to delete your personal information, including when the information is necessary to complete the transaction for which the personal information was collected, to provide a good or service requested by you, to comply with a legal obligation, to engage in research, to secure our website or other online services or to otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided the information.

 

Right Not to be Subject to Discrimination

Should you exercise any of your privacy rights as a California consumer, we will not discriminate against you by offering you different products or by providing you with a different level or quality of services, based solely upon your request. however, in some circumstances, for example where you have requested or consented to our services that use your personal information to provide the service, we may not be able to provide a service if you choose to delete your personal information.

To exercise any of these rights, or to designate an agent or authorized representative to act on your behalf, you can contact via our website, www.itsjobvious.com, to submit an electronic request for the deletion of your personal information. When you submit a data subject rights request through one of these designated methods, we will use the information you submit and the information we have in our systems (or through the systems of our service provider if we use a service provider) to try to verify your identity and to match the personal information we have collected about you, if any, to your identity. If we are successful in validating your identity, we will respond to your request within the time and in the manner required by the CCPA. If we cannot validate your identity, we will attempt to contact you to inform you of this issue.
